On Feb. 14, 2007, three victims of a roadside-bomb explosion were rushed into the hospital where Air Force Maj. (Dr.) Derek Speten, the 66th Medical Group Diagnostics and Therapeutics flight commander, worked. Airmen Missing From Vietnam War Identified
The Department of Defense POW/Missing Personnel Office announced today that the remains of nine U.S. servicemen, missing in action from the Vietnam War, have been accounted-for and returned to their families for burial with full military honors. Air Force Col. William H. Mason, Camden, Ark.; Lt. Col. Jerry L. Chambers, Muskogee, Okla.; Maj. William T. McPhail, Chattanooga, Tenn.; Maj. Thomas B. Mitchell, Littleton, Colo.; Chief Master Sgt. John Q. Adam, Bethel, Kan.; Chief Master Sgt. Calvin C. Glover, Steubenville, Ohio; Chief Master Sgt. Thomas E. Knebel, Midway, Ark.; Chief Master Sgt. Melvin D. Rash, Yorktown, Va.; and Master Sgt. Gary Pate, Brooks, Ga., were buried as a group today in Arlington National Cemetery. The individually identified remains of each airman were previously returned to their families for burial.

Wilton Man Sentenced for Felon in Possession and Unlawful Taking of Bald Eagle

BISMARCK—Acting United States Attorney Lynn Jordheim announced that on June 2, 2010, Jesse Marchus, 30, of Wilton, North Dakota, was sentenced before United States District Court Judge Daniel L. Hovland on counts of possession of firearm and ammunition by a convicted felon and unlawful taking of bald eagle. Marchus was found guilty by a federal jury on February 10, 2010.

On the count of possession of firearm and ammunition by a convicted felon, Judge Hovland sentenced Marchus to serve eight years and four months in federal prison, to be followed by three years of supervised release. Marchus was ordered to pay a $100 special assessment to the Crime Victim’s Fund. On the count of unlawful taking of bald eagle, Marcus was sentenced to serve one year in federal prison, to be followed by one year of supervised release. Marchus was ordered to pay a $25 special assessment to the Crime Victim’s Fund. The sentences will run concurrently.

In March 2009, U.S. Fish & Wildlife received information that Marchus shot a bald eagle in northen Burleigh County, along the Missouri River, west of Wilton. An investigation led to the execution of a search warrant at that location, on May 8, 2009, at a cabin believed to be Marchus’s residence. During the search, law enforcement officials seized nine firearms, over 1,000 rounds of ammunition and a pair of bald eagle feet. Marchus had previously been convicted of burglary in 2003, possession of drug paraphernalia in 2003, and felon in possession of a firearm in 2006 in Burleigh County District Court. Because of these convictions, Marchus was prohibited from possessing a firearm or ammunition.

The case was investigated by the U.S. Fish & Wildlife, Bureau of Alcohol, Tobacco, Firearms & Explosives, Federal Bureau of Investigation, North Dakota Game & Fish, North Dakota Bureau of Criminal Investigation and Burleigh County Sheriff’s Office.

Assistant United States Attorney David Hagler prosecuted the case.

Colorado Couple Pleads Guilty to Illegal Trapping and Sale of Bobcats

June 2, 2010 - A Colorado couple pleaded guilty in a Denver federal court to charges related to the illegal trapping and interstate sale of bobcats, the Justice Department announced today.

Jeffrey M. Bodnar, 37, pleaded guilty Tuesday to one felony count of conspiracy to violate the Lacey Act, and one felony count of possession of a firearm by a felon. His wife, Veronica Anderson-Bodnar, 46, pleaded guilty to one misdemeanor count of Lacey Act trafficking and one misdemeanor count of making false statements in violation of the Lacey Act. Both defendants reside in Hartsel, Colo.

The Lacey Act is a federal law that makes it illegal to transport or sell in interstate commerce any wildlife taken, possessed, transported or sold in violation of state law or regulation. Bobcats, whether alive or dead, including their pelts and other parts, are considered wildlife under the Lacey Act.

In court documents, Jeffrey Bodnar admitted to conspiring with his wife to unlawfully trap and kill bobcats without a license and using prohibited leghold traps in violation of Colorado law, and to sell the bobcat pelts to fur buyers in Montana and Kansas. He also admitted to conspiring with his wife to submit false records to the Colorado Division of Wildlife in order to obtain tags for the pelts. With regard to the firearms charge, Bodnar, who was convicted of a state felony charge in 2000, admitted to possessing at least one firearm. The prosecution indicated in court documents that it will seek at sentencing to prove that Bodnar possessed as many as seven firearms.

Jeffrey Bodnar is scheduled to be sentenced on Oct. 15, 2010. He faces a maximum penalty of five years in prison and a $250,000 fine on the conspiracy charge, and a maximum penalty of ten years in prison and $250,000 fine for the firearms charge.

In separate court documents, Veronica Anderson-Bodnar admitted to selling bobcat pelts to a buyer from Kansas in March 2008, when she should have known that the bobcats were trapped without a license and using prohibited leghold traps. She also admitted to making and submitting false records to the Colorado Division of Wildlife in order to obtain tags for the pelts.

Veronica Anderson-Bodnar is scheduled to be sentenced on Oct. 15, 2010. She faces a maximum penalty of one year in prison and a $100,000 fine on each count. According to court documents, the government will recommend to the court that she be sentenced to five years of probation during which time she will be prohibited from possessing firearms and also prohibited from hunting, trapping, or fishing, or accompanying anyone hunting, trapping, or fishing, anywhere in the United States.

The case was investigated by the U.S. Fish & Wildlife Service and the Colorado Division of Wildlife. The case is being prosecuted the U.S. Attorney’s Office for the District of Colorado and the Justice Department’s Environmental Crimes Section.
